The Terms and Conditions listed here are legally binding between you (herein referred to as "you") and Heartland Yoga private limited (herein referred to as "We" or "Us") for your registration to participate in the Yoga Teacher Training Program (or any other related services) offered by us. By using our Website www.heartlandyog.org (herein referred to as "Site"), or by providing personal information to us (or through this Website), you agree and consent to the collection, storage, use, and disclosure of this information per this privacy policy.
"Personal Information" is any details that enable us to wholly or partly identify You, such as Your e-mail address, name, shipping, and billing address, telephone number, company name, credit card information, any form of identification number, or one or many data about your physical, physiological, mental, economic, cultural, or social identity. The data will be collected from individuals only if they voluntarily agree to be a part of Heartland Yoga's services and submit this information willingly without any undue influences. Unless indicated otherwise, the collected information will be kept confidential in our files and protected from any unbiased observer. We follow a direct data collection method from individuals without any third-party services. All collection will be done only with implied consent. Before registering with us, you must ensure that your documents are up-to-date, accurate, and complete.
By registering with us and accessing this Website (www.heartlandyog.org), You confirm that You have read, understood, and agree to be bound by these Terms & Conditions. You hereby represent and warrant that You are competent to enter into these Terms. You confirm that You have read, understood, and agree to these Terms. We reserve the right to revise the Terms & Conditions at any time and at our sole discretion. All changes made to the policies will be effective immediately. By agreeing, you also confirm that it is your responsibility to visit our Website to see for updates in the privacy policy.
If You do not agree with all of these current terms, or in the future, any of its modified forms, then You are expressly prohibited from using the Site, and you must discontinue use immediately.
We may use the data we acquire from you to further our authorized operating and development goals upon your explicit or implied consent, such as:
a) The minimum age limit to participate in the Program is 18 years. No one under 18 years shall register for the Program on their own or provide any personally identifiable information in this regard without parental consent. In cases of underage participants, we mandate the submission of personal information of both the Participant and their parent/ legal guardians.
b) To register for the Program, You must provide complete and accurate details/information as asked for on the registration page.
c) Your registration for the Program will be completed only after You receive a verification e-mail confirming Your registration and participation.
d) The Program registrations are subject to availability.
e) If You are accessing the Site from outside the territory of India, then You must be of competent age to enter into a contract as per the local laws of Your location.
The payment must be made in INR according to the chosen YTT programs before the commencement of the YTTC. In case of cash payment, You must complete your remittance no later than the first day of course instruction.
We accept the following modes of payment:
In the event the prerequisites as mentioned in these Terms & Conditions are not fulfilled, We reserve the right to cancel Your registration, and the refund will be processed as per the cancellation and refund policy provided below.
a. If a refund request is received on or before the 2-week schedule time, 10% of the Program fee will be deducted for cancellations.
b. If a refund request is received between 7 to 3 days of the scheduled time, 50% of the Program fee will be deducted for cancellations.
c. No requests for refund will be accepted after the YTTC schedule has commenced or for a no-show, or for an incomplete attendance of the Program.
For those who test positive for COVID-19 (before three days of travel):
All cancellation requests should be sent in writing to enroll@heartlandyog.org. No other mode of communication for refund requests will be accepted.
In case You are not allowed to continue the Program due to medical reasons or code of conduct, you are ineligible to claim or apply for any refunds.
The refund request can be processed within 30 days from the date of request from the registered e-mail ID.
The effective date for processing the refund will be from the formal receipt of the cancellation notification, in writing with supporting documents where applicable.
a. You have the option of transferring Your registration for the YTTC to a family member, relative, or friend anytime on or before YTTC starts by sending an e-mail to enroll@heartlandyog.org. No other mode of communication for transfer requests will be accepted. Your e-mail must enclose details about the person to whom you want to transfer the seat, indicating that your transfer is voluntary and consented.
b. The transferee shall complete the registration process online, and the application will be processed and reviewed as per the standard procedure before confirming the registration.
c. The terms of transfer are applicable only for the specific YTTC it was originally registered for, and they cannot be transferred to any other courses or YTTC.
d. No transfers will be allowed after YTTC begins.
All guidelines and social distancing protocols in accordance with the notification/guidelines/orders issued by the Government, local health officials, and Us must be adhered to at all times. You may be subject to regular medical checkups upon arrival and during the YTTC.
In the event You develop any COVID-19 symptoms during the YTTC, You agree to follow the protocols as prescribed by health officials at Heartland Yoga from time to time.
a. The YTTC registration includes foods & accommodation for the YTT participants from the commencement of the training to the end of the course.
b. Each Participant will be allocated as per Your chosen category.
c. If You wish to arrive early and/or extend Your visit beyond the YTTC dates, You may do so by booking the additional accommodation. For assistance, please contact: support@heartlandyog.org
As a prerequisite to the registration process, You will have to fill the medical declaration form. The Participant shall ensure that all the information which You have provided are true, complete, and up-to-date. You must carry Your regular medications while traveling for the Program. If You are suffering from chronic health problems, such as epilepsy, heart ailments, uncontrolled blood pressure or diabetes, asthma, psychological problems, physical disabilities, it is mandatory that You mention such information in the Medical Questionnaire during the registration process.
In the event of a medical condition arising during Your stay at Heartland Yoga, You agree to abide by the recommendations made in Your best interests by the medical team in charge of the Program. This might include taking medications, referral to a nearby hospital for further care, discontinuing the Program, or leaving the Center. You shall bear any medical expenses that You may incur during Your stay for the Program.
If You experience any symptoms of COVID-19, You shall inform Us and must follow the treatment and guidelines as prescribed by Us. You must make travel arrangements to the Program only after securing due permissions from the concerned governmental authority. By agreeing to participate in our YTTC, you agree and confirm that:
I hereby acknowledge and agree to take full responsibility for my health during my stay at Heartland Yoga.
I agree to provide Heartland Yoga with the full, correct, and up-to-date details of all/any of my medical conditions. In the event of any emergency or unforeseen health-related complications, I agree to abide by the recommendations made in my best interests by the medical team of Heartland Yoga Center. Any medical expenses incurred in this regard will be fully borne by me.
If I am not in a position to communicate or decide about my treatment options, the medical team at Heartland Yoga can decide the course of action even before my family is informed or arrives in case of emergencies.
I agree to indemnify and hold Heartland Yoga harmless with respect to my health, ailments, or recovery during my stay at the Center. Heartland Yoga shall not be liable and does not hold any responsibility for the same.
I understand that the Center only has a small facility for immediate health care but does not have any other facilities apart from that.
I understand that, due to the current COVID-19 Pandemic, Heartland Yoga Center has formulated certain protocols and guidelines to prevent the spread of COVID and ensure the safety and well-being of everyone who resides in the Heartland Yoga Center. I hereby agree to follow all the protocols, guidelines that are already in place and that will be formulated from time to time during my stay at Heartland Yoga. The Guidelines will keep changing in line with the guidelines and recommendations notified by the Government from time to time in terms of symptoms, isolation, protection, and treatment protocols. I understand and agree to follow these guidelines, and in the future, any modifications of these guidelines.
I understand that Heartland Yoga has a limited supply/variety of medications, and I agree to carry all the regular medications that I would need throughout my stay at the Center, including any and all prescriptive medicines, including supplements adequate for the duration of the stay.
I agree to carry all the protective masks/equipment/materials required in times of COVID-19 to protect myself from the infection.
I fully understand the risks involved due to COVID–19 and am aware of all the regulations/safety guidelines prescribed by the Government. I undertake that I will strictly follow the same. I shall not hold Heartland Yoga responsible for any health-related issue, including COVID–19, during my stay at the Heartland Yoga Center and shall indemnify Heartland Yoga from any liability arising out of the same.
I also agree that in the event of incomplete or false information given by me, I will not be allowed to participate in the Program or continue even if in the midst of the Program. I declare that the information I have given is true to the best of my knowledge.
We reserve the right to allow admission into the Heartland Yoga Center and/cancellation of Your participation at Our sole discretion.
You agree to behave in such a way as to create a safe, supportive learning environment while at the Program. You agree not to smoke, drink alcohol or consume any hallucinogenic or banned drug. You agree not to engage in disruptive speech or behavior or otherwise interfere with the Program or other individual's participation in the Program. You will comply with all applicable laws and agree not to engage in any form of harassing, offensive, discriminatory or threatening speech or behavior, including but not limited to race, gender, sexual orientation, religion, or disability. Participants engaging or threatening to engage in such behavior will be requested to leave the Program or related Program immediately, and such Participants will not be eligible to receive a refund of any fees paid towards their participation in the Program. If You witness such behavior, please promptly contact the Program Director in order to take appropriate action.
You acknowledge and agree that Your attendance and participation in the Program are voluntary. Since attending any of the sessions could involve the physical activity of learning Yoga, You agree to assume the risks associated with attending and participating in the Program to the fullest extent permitted under applicable law. To the extent permissible by law, You agree to indemnify Us against any and all claims, actions, losses, and damages arising out of or relating to Your participation in the YTTC.
You consent to the collection and use of Your personal information that You provide in connection with the Program by Us. We will use Your information to send details and announcements related to the YTTC to You. Any personal information that You provide to Us online will be handled in accordance with the laws and regulations of India. We are committed to protecting Your personal information and Your right to privacy. Our Privacy Policy governs the privacy policies of Our Site. You agree that We may use any information that We obtain about You in accordance with the provisions of Our Privacy Policy. Please read Our Privacy Policy carefully, as it will help You make informed decisions about sharing Your personal information with Us.
In consideration of the opportunity to participate in the Program, You grant Us an irrevocable, non-exclusive, royalty-free right and license throughout the world and in perpetuity to reproduce, edit, publish, distribute or translate, for promotional/educational purposes, all or any part of the following items ("Items" ): (a) all still photographs (b) all audio and video recordings in connection with the YTTC. You consent to the use of the Items pursuant to the foregoing in perpetuity without compensation (unless prohibited by law) or additional consents from You and waive any moral rights You may have in the Items.
In consideration of being allowed to register for and participate in the YTTC, You hereby warrant and represent that You are at least 18 years of age with parental consent or above 18 years of age and freely waive, release from liability, assume all risks, and covenant not to sue Us or Our members, employees, board members, agents, or volunteers for any expense, loss, damage, personal injury, including loss of life, disability, property damage, or property theft or actions of any kind that You may hereafter suffer or sustain before, during, or after the Program, unless said expense, loss, damage, personal injury, including loss of life, disability, property damage or property theft or actions of any kind is caused by the sole, gross negligence by Us. This Waiver of Liability is specifically binding upon Your heirs and assigns and is knowingly given by You.
In the event that it is made impossible or impractical or illegal for Us to proceed with or carry out this Program in whole or in part, due to any natural calamity, a general or specific order of Government, fire, casualty, flood, earthquake, war, strike, demonstrations, lockout, pandemic, epidemic, destruction of its facilities, riot, insurrection, materials unavailability, or any other cause(s) beyond Our reasonable control, as a result thereof, We may delay, postpone, reschedule, terminate and/or cancel this Program, and will not be liable for any losses or damages incurred by the Participant.
In no event will We or Our subsidiaries, affiliates, and all of Our respective officers, volunteers, agents, partners, teachers, trustees, founder, and employees be liable to You or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from Your use of the Site, even if We have been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, Our liability to You for any cause whatsoever and regardless of the form of the action will at all times be limited to the cost of the YTTC.
You agree to defend, indemnify, and hold Us harmless, including Our subsidiaries, affiliates, and all of Our respective officers, volunteers, agents, partners, teachers, trustees, founder, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees and expenses, made by any third party due to or arising out of Your participation of the Program and/or breach of these Terms & Conditions.
Notwithstanding the foregoing, We reserve the right, at Your expense, to assume the exclusive defense and control of any matter for which You are required to indemnify Us, and You agree to cooperate, at Your expense, with such claims. We will use reasonable efforts to notify You of any such claim, action, or proceeding which is subject to this indemnification upon becoming aware of it.
a) In view of the recent outbreak of the Coronavirus, the Terms & Conditions listed herein are subject to change from time to time. Any modifications to the "Terms & Conditions" will be posted on the Site and shall be notified to You through e-mail. The modified Terms & Conditions shall also be binding upon You.
b) The Program is subject to changes as per the directions issued by the Government and the local health authorities from time to time.
c) You agree that Your failure to adhere to any of the Terms & Conditions set out above, or any other provision of these Terms & Conditions, shall constitute a breach of these Terms & Conditions on Your part which may result in the termination of Your access to the Site and/or participation in the Program.
d) If any provision or part of a provision of these Terms & Conditions is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Terms & Conditions and does not affect the validity and enforceability of any remaining provisions. There is no joint venture, partnership, employment, or agency relationship created between You and Us as a result of these Terms & Conditions or use of the Site.
You agree that these Terms & Conditions will not be construed against us by virtue of having drafted them.
